Due Process

The Affiliate fights to ensure that government agencies and municipalities proceed fairly when dealing with citizens in their day-to-day dealings with the bureaucracy. Legal rights cannot be vindicated when the government denies or severely limits the rights of individuals to seek relief in the courts. Nor can they be preserved if attorneys are unfairly limited in zealous advocacy on behalf of their clients.

Court Cases

Some of our current due process lawsuits include Carbone v. State of Rhode Island, filed against the DMV for suspending drivers' licences without cause, and University of Rhode Island Student Senate v. Town of NarragansettSee more due process court cases.

Due Process in the News

November 2, 2012 - Last night, the Providence City Council moved toward approving a disturbing ordinance allowing police to identify as “nuisance properties” any residence to which they are called more than once in a period of time.  Crafted to discourage landlords from renting to “the wrong people”, this ordinance will encourage discrimination by landlords and discourage tenants from calling police when help is needed.  A final vote is expected on November 19.  Read our letter to the City Council here.
